This Cancellations, Returns and Refunds Policy is an integral part of the Terms of Use and Sale (the “Terms”), found at: https://moderntalkbooks.com/store-policy, and all the terms contained herein apply to any sale of Goods or provision of services by the company named “Modern Talk Books Ltd” (the “Company”, “we”, “us”, “our”), through the website moderntalkbooks.com (the “Website”). Terms used but not defined herein shall have the respective meanings given to them in the Terms.
Ordering Goods through the Website or App is considered a “Distance Contract” that has the meaning attributed to that term by Section 15 of the Consumer Protection Law of 2021 (Law 112(I)/2021) of the Republic of Cyprus (the “Law”).
Digital Goods
As soon as an eBook is unlocked, purchased or otherwise activated, it is immediately available for use; we therefore do not allow for cancellation of eBook transactions. If you are unable to use our App for any reason, please contact us so that we can try and assist you or consider your entitlement to a refund.
Physical Goods
In accordance with the Law, you may cancel your order for the Goods within fourteen (14) days from the day on which you or a third party designated by you, other than the carrier, takes physical possession of the Goods, and receive a refund. In order to cancel your order, you must send us a cancellation request (“Cancellation Request”) by email to support@moderntalkbooks.com. We will then contact you back with specific instructions on the next steps.
Your Cancellation Request must indicate the details of your order and your statement requesting to cancel your order. You must return the Goods to the Company without undue delay and in any case within fourteen (14) days from the day on which you notified us of your decision to cancel, and you will bear the direct cost of returning the Goods to us.
In all instances of cancellation in accordance with the terms and procedures contained herein, including cancellations due to a discrepancy between the Goods and the details provided on the Website, you must return the Goods exactly in the perfect and original condition in which they were received, in their complete original packaging (box, nylon, foam etc. – if and where applicable), without tears and/or damage and/or alterations and/or otherwise, and with all the contents of the original packaging (bookmarks etc.). If the cancellation of the order is due to a defect in the Goods, you must notify us in accordance with the terms provided herein, with adequate details regarding the defect and if possible, include a photo of the damage/printing error, so we can assist you and consider your entitlement to a replacement or a refund.
We will process your cancellation and return any payment received from you, including, where applicable, delivery charges, within fourteen (14) days of the day on which we are notified of your decision to cancel, using the same means of payment as those used by you for the original transaction. We reserve the right to withhold the refund until we have received the Goods back or until you provide us with evidence that you have sent back the goods, whichever occurs first.
Notwithstanding the above, we are not required to refund any additional delivery charges if you chose a mode of delivery other than the cheapest mode of delivery offered by us.
Goods that were sold with an additional gift must be returned by you with the additional gift, otherwise the value of the gift will be deducted from the refunded amount.
